1. Cancellation by the Client
The client has the right to cancel the construction contract at any time before work begins. Once work has started, cancellation will be subject to the following conditions:
1.1. Cancellation Before Work Begins
- Within the first 14 calendar days from contract signing: the client may cancel without penalty, with the right to a full refund of the initial deposit.
- After 14 days and before work begins: the client will be entitled to a 50% refund of the initial deposit. The remaining 50% will cover administrative costs, preliminary studies, and planning.
1.2. Cancellation Once Work Has Started
If the client decides to cancel the project once work has begun, the following will apply:
- A detailed inventory of executed work and purchased materials will be conducted.
- The client must pay for the work completed up to the cancellation date, including:
- Materials already purchased specifically for the project
- Labor already performed
- Machinery and equipment mobilization costs
- Subcontractor costs already committed
- Any remaining balance, if applicable, will be refunded within a maximum of 30 days.
2. Cancellation by Emproconstruction
Emproconstruction reserves the right to cancel the contract under the following circumstances:
- Non-payment by the client of invoices within the established deadlines, following a 15-day prior notice.
- Inability to access the property to perform work on the agreed dates.
- Failure to obtain necessary permits or licenses by the client.
- Force majeure circumstances preventing project execution.
In case of cancellation for reasons attributable to Emproconstruction (excluding force majeure), the client will receive a full refund of all amounts paid within a maximum of 30 days.
3. Initial Deposit
To reserve the date and plan the project, an initial deposit of 30% of the total budget is required. This deposit confirms acceptance of the contract and reserves the technical team for the agreed dates.
4. Project Modifications
Modifications requested by the client during project execution may affect timelines and budget. If a modification involves canceling work already started, the client will be responsible for costs incurred up to that point.
5. Refunds for Delays Attributable to Emproconstruction
If Emproconstruction incurs unjustified delays exceeding 30 days from the agreed delivery date, the client will be entitled to:
- Request contract cancellation with full refund of all amounts paid, or
- Accept financial compensation equivalent to 5% of the budget for each month of delay, up to a maximum of 20%.
Delays caused by force majeure, adverse weather conditions, lack of permits attributable to the client, or modifications requested by the client are excluded from this clause.
6. Procedure to Request a Refund
To request cancellation and the corresponding refund, the client must:
- Notify Emproconstruction in writing via email at Emprosupport@gmail.com or by certified mail to our office.
- Indicate the reason for cancellation and the contract details.
- Emproconstruction will respond within a maximum of 7 business days confirming receipt and detailing the process to follow.
- The refund, if applicable, will be made using the same payment method originally used within a maximum of 30 days from cancellation confirmation.
7. Exclusions
No refund will be made in the following cases:
- When the client has failed to meet payment obligations.
- When the client has not provided necessary access for work execution.
- When canceled work has been partially executed and the value thereof exceeds the amounts paid.
- In case of cancellation due to force majeure affecting Emproconstruction.
